Important: SPORE AI is an educational tool. It is not a medical device and does not provide medical or veterinary advice. Never rely solely on SPORE AI when safety is at stake. In any emergency involving suspected poisoning, contact emergency services or a poison control center immediately.

1. Acceptance of Terms

By downloading, installing, or using the SPORE AI application or website (collectively, the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms form a legally binding agreement between you and SPORE AI ("we," "us," or "our"). Please read them carefully.

2. Description of Service

SPORE AI is a mobile application that uses artificial intelligence to identify mushroom species from photographs and provide educational information about toxicity levels, exposure risk estimates, and symptom timelines. The Service is intended to increase awareness and understanding of mushroom safety.

3. Educational Use Only — No Medical Advice

SPORE AI is an educational tool. The information it provides — including species identifications, toxicity ratings, exposure risk estimates, and symptom timelines — is for informational and educational purposes only.

SPORE AI is not a medical device. It does not provide medical, veterinary, or professional safety advice. AI identification can be incorrect. Species that appear similar may have very different toxicity profiles.

4. Eligibility

You must be at least 13 years of age to use SPORE AI. By using the Service, you represent that you are at least 13 years old. Users between 13 and 18 must have parental or guardian consent.

The Service is available globally where not prohibited by local law.

You may use SPORE AI for personal, non-commercial, educational purposes in accordance with these Terms.

6. Intellectual Property

All content, design, software, logos, and AI models within SPORE AI are the intellectual property of SPORE AI or its licensors and are protected by copyright, trademark, and other applicable laws.

These Terms do not grant you any rights to use SPORE AI's name, logos, or branding without our prior written consent.

7. User Content

When you submit images to the Service for identification, you grant SPORE AI a limited, non-exclusive, royalty-free license to process those images for the sole purpose of providing you with identification results.

You may separately opt in to contribute anonymized scan data to improve our AI models. This is always optional and clearly disclosed within the app. Opting out does not affect your access to the Service.

You represent that you have the right to submit any content you provide and that doing so does not violate any third-party rights.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

We do not warrant that identifications will be accurate, complete, or free of error. Species identification using photographs is inherently uncertain, and AI systems can make mistakes. We expressly disclaim any warranty that the Service is suitable for emergency or safety-critical use.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SPORE AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, ILLNESS, DEATH, OR PROPERTY DAMAGE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) USD $10.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In such jurisdictions, the above limitations apply to the maximum extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless SPORE AI and its officers, employees, and agents from and against any claims, liabilities, damages, and expenses (including reasonable legal fees) arising out of or related to your use of the Service or your violation of these Terms.

11. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or if we discontinue the Service.

You may stop using the Service at any time. Sections 3, 8, 9, 10, and 13 of these Terms survive termination.

12. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you via an in-app notice at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through binding arbitration or, where not permitted, in the courts of competent jurisdiction.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
